The settlement also established the Great
Lakes Fishery Trust, a nonprofit organization governed by
the parties to the settlement. The Trust manages the assets
generated by the settlement.
The purpose of the Great Lakes Fishery
Trust, defined by the Settlement Agreement, is
“...to mitigate for the lost use
and enjoyment of Lake Michigan fishery resources forgone as
a result of the operation of the Ludington Pumped Storage
Project and to benefit the Great Lakes fishery by providing
funding for enhancement, propagation, protection and replacement
of Great Lakes fishery resources.”
The Settlement Agreement also defines
the use of trust funds. Permitted uses include:
- Research projects directed at increasing
Great Lakes Fishery resources
- Rehabilitation of lake trout, sturgeon,
and other Great Lakes fish species
- Protection and enhancement of Great
Lakes fishery resources
- Public education concerning the Great
Lakes
- Acquisition of property for the above
purposes or to provide access to the Great Lakes fishery
The board of trustees of the Great Lakes
Fishery Trust is made up of representatives of the parties
to the Settlement Agreement. Trustees represent the following
organizations:
- Michigan Department of Natural Resources
- Michigan Department of the Attorney
General
- Michigan United Conservation Clubs
- National Wildlife Federation
- Grand Traverse Band of Ottawa and Chippewa
Indians
- U.S. Fish and Wildlife
Service
The Little River Band of Ottawa Indians
and Little Traverse Bay Bands of Odawa Indians have designated
provisional trustees who participate in Trust activities but
do not vote. The utilites, while parties to the settlement,
do not serve on the board of trustees.
The Settlement Agreement also designated
a Scientific Advisory Team to advise the board of trustees
on project funding, to monitor the barrier net, and to advise
the Trust on the protection of Trust property with fishery
values. Representatives of the following organizations serve
on the Great Lakes Fishery Trust Scientific Advisory Team:
- Michigan Department of Natural Resources
- U.S. Fish and Wildlife Service
- Grand Traverse Band of Ottawa and Chippewa
Indians
- Michigan United Conservation Clubs
- National Wildlife Federation
- The Detroit Edison Company
- Consumers Energy
- Michigan State University representative

- Little River Band of Ottawa Indians
- Little Traverse Bay Bands of Odawa
